Indemnification:

To the maximum extent allowed by law, the undersigned does hereby indemnify, defend and hold harmless the City of Edinburg and their elected and/or appointed officers, officials, agents, employees, volunteers and subcontractors (the “City”) from and against any and all causes of action, claims, liabilities, obligations, judgments, losses or damages, including reasonable attorneys’ fees and cost of litigation (“claims”) arising out of, or in connection with, the participation of the undersigned in the City of Edinburg Events; excepting only loss, injury, damage or cost that arise out of the intentional wrongful acts, violations of law, or the sole active negligence of any of the above named entities.

Limitation of Liability:

The undersigned agrees to limit the City’s liability arising from City’s acts, errors, or omissions such that the total liability of City shall not exceed the total fees paid by the undersigned to the City in connection with the City of Edinburg Events. The undersigned agrees that City will not be liable for any indirect, incidental, special, or consequential punitive or multiple damages, including without limitation any damages resulting from loss of use, loss of business, loss of revenue, loss of profits, arising in connection with this Application, the participation of the undersigned in the City of Edinburg Events, or of any other obligations relating to this Agreement, even if City has been advised of the possibility of such damages. The foregoing limitation of liability shall apply to the maximum extent allowed by law for limitation of City’s liability, regardless of the cause of action under which such damages are sought.

 

Guidelines

Artist/ Retail

Fee

  • Vendor booth options: $100 (Space Only)

  • No temporary checks

  • Payments must be received by 5 p.m. no later than one week before the festival date.

  • Payments made the week of the event will incur a $10 late fee. Payments made on the day of the event will incur a $20 late fee.

  • No refunds; only credits are provided if the City cancels the event due to inclement weather. Credit may be issued at the discretion of the City.

Facilities

  • Outdoor locations throughout the City of Edinburg.

  • Vendors must provide their own equipment (10x10 canopy, tables, chairs, lighting, and extension cords).

Set-Up

  • Vendors must finish setting up one hour before the start of the event.

  • Unless previously arranged, only one vendor per space.

Display Guidelines

  • Vendors may only hang signs, banners, and other displays within their allotted booth space.

  • The area immediately in front of and around booths must be clear of obstruction.

  • Cords, ropes, and other trip hazards must be covered or safely placed out of traffic.

  • The City reserves the right to remove items deemed unsafe or distracting.

  • Tax ID certificates must be displayed at all times during the event.

Electricity

  • Limited electrical outlets are provided. Battery-operated sources are encouraged.

  • Low-noise generators are allowed.

Tear Down

  • Vendors must wait until after the event to begin teardown.

  • Vendors are responsible for cleaning up their area.

Code of Conduct

  • Vendors are expected to be courteous, respectful, and professional.

  • Vendors who violate the code of conduct may be asked to leave without refund and may be excluded from future events.

Artwork Content

  • Festivals are public events, and vendors must use reasonable judgment when selecting artwork for display.

  • Any content deemed inappropriate may be removed at the City’s discretion.

Vendors and Products

  • Artist Vendors: Artists work in disciplines such as painting, sculpture, drawing, and printmaking, often exhibiting their work in galleries, museums, and art shows.

  • Retail Vendors: Offer mass-produced items.

  • Products sold must match the festival’s theme, with 30% of inventory aligning with the festival’s theme.


Food Vendors / Food Trucks

Health & Safety Requirements

  • All food vendors must obtain a temporary health permit. Contact the City Health Department at (956) 388-1839 for details.

  • Each booth must have one (1) certified food handler present.

  • Food permits must be clearly visible.

  • Fire extinguishers are required at all times.

  • City food handler ID tags are required.

Food Preparation & Sales

  • Food must be from an approved source (no homegrown produce or home-baked goods).

  • Food preparation must be done on-site (no home preparation allowed).

  • Each vendor is limited to three (3) menu items. No two vendors may sell the same items.*

Fee

  • $200 per event per 10x10 booth space or food truck.

  • No refunds; only credits are issued if the City cancels the event due to inclement weather.

Set-Up & Electricity

  • Vendors must be set up and ready for inspection one hour before the event.

  • Temporary food permits are issued after inspection.

  • Electricity is provided to all food vendors.

Loading/Unloading

  • Vendors will receive loading/unloading and parking instructions before the event.

  • Vendors must unload and park in designated areas.

Disposal of Food & Trash

  • Food waste must be double-bagged per Health Codes.

  • Trash must be placed in receptacles.

  • No dumping in sewers except for water and ice.

Tear Down & Clean-Up

  • Vendors must wait until the event is over to begin teardown.

  • Vendors are responsible for cleaning their area and disposing of waste properly.

Code of Conduct

  • Vendors must be professional, respectful, and courteous to attendees and other vendors.

  • Violating the code of conduct may result in immediate removal without compensation and exclusion from future events.
